The Firm has an established Antitrust and Competition Practice that advises our clients in matters of Mexican federal antitrust laws including merger clearance, and compliance with the Mexican antitrust and competition laws, and investigation proceedings initiated by the Mexican antitrust authorities.

Merger Control:

Before a transaction over a certain threshold can take place, it must be cleared by the Mexican Antitrust Commission. Not only must prior notice be given to the Antitrust Commission that a concentration is taking place, but the economic agents involved must also adhere to the antitrust laws during the negotiation, notification, and due diligence process.

Antitrust Compliance:

Compliance with antitrust laws is achieved by implementing internal company mechanisms not to incur in certain conducts or situations in which a business may be penalized. These mechanisms help mitigate liability in case of investigations by the Mexican Antitrust authorities and are put together to ensure compliance with antitrust laws through the training and guidance of key officers, as well as the creation of mechanisms to report anticompetitive behavior.
